Terms and Conditions

These Terms and Conditions apply to subscriptions and services offered by WeFit Project S.R.L. through the wefit.md website and mobile application. WeFit is a fitness subscription platform that provides access to partner gyms, studios, and wellness centres in Chișinău. For the best use of the platform, we recommend carefully reading the Terms and Conditions presented below. We reserve the right to make changes to these provisions without prior notice.

1. General Provisions

This platform is owned by WeFit Project S.R.L.. By purchasing a subscription through the platform, the Buyer accepts the Terms and Conditions for the provision of services (hereinafter – Terms and Conditions) presented below. Use of the platform implies acceptance of the Terms and Conditions proposed by WeFit Project S.R.L., in accordance with Law No. 284/2004 on Electronic Commerce. The relationship between the client and the provider is governed by Law No. 105/2003 on Consumer Rights Protection and other regulations adopted in accordance therewith. The Provider reserves the right to modify these Terms and Conditions, and the Buyer is obligated to monitor any changes.

2. Personal Data Protection

By using the wefit.md platform, you automatically consent to the collection and processing of personal data necessary for the processing, confirmation, and fulfilment of subscriptions. Personal data is processed only for legitimate purposes, such as providing the ordered services, promotions, usage analytics, cookies, and notifications. All information containing personal data is stored and used only for the period necessary to achieve the purposes for which it was collected and in accordance with the provisions of Law No. 133/2011 on the Protection of Personal Data. We employ security measures to prevent unauthorized access, maintain data accuracy, and ensure the correct use of information on the platform.

3. Order Registration and Payment

Subscription payments are made online by payment card. After payment, you will receive a payment confirmation by email containing the order number, merchant name (WeFit), amount, currency, payment date, and order description. The payment processor uses a secure system based on the latest version of the 3D-Secure security standard, which provides a global approach to authenticating buyers in secure online transactions. This security measure involves redirecting the user to a secure maib page where each cardholder is authenticated using a one-time code for each online transaction. Refunds are issued only to the payment card that was used for the purchase. To make a payment, you will need to enter your bank card details on the payment processor's secure page. The information is transmitted in encrypted form and stored only on the specialised server of the payment system. WeFit does not collect or store bank card data. The following details will be requested for payment: • Card number (16 digits) • Expiry date (month and year) • CVC or CVV code (3 digits) • Name on the payment card If the card currency differs from the transaction currency (MDL), the conditions of the issuing bank will apply when converting the amount.

4. Service Activation and Delivery

WeFit provides digital services in the form of subscriptions that grant access to partner fitness venues and wellness centres. After payment confirmation, the subscription is activated immediately in your account and becomes available on both the WeFit website and mobile app. Access to partner locations is provided through the check-in feature in the WeFit mobile app, according to the chosen subscription type (number of visits per month, validity period). The subscription is personal and non-transferable.

5. Return and Cancellation Policy

In accordance with Law No. 105/2003 on Consumer Rights Protection, the Buyer has the right to request a refund within 14 days of payment, provided that the service has not been used (no visits made). Refunds are issued to the card from which the payment was made. If the subscription has been used (at least one visit made), no refund will be granted. Subscription cancellation can be requested at any time from the account settings. The subscription remains active until the end of the paid period and does not renew automatically. 6. Privacy Policy

In accordance with the provisions of Law No. 133/2011 on the Protection of Personal Data, WeFit Project S.R.L. processes personal data in good faith and in compliance with legal provisions. Personal data processing is carried out through mixed means (automated and manual), in compliance with legal requirements and under conditions that ensure the security, confidentiality, and respect for the rights of data subjects. WeFit collects and processes only the personal data provided by users when creating an account and placing an order: first name, last name, email address, phone number. Personal data is used exclusively for platform administration, to enable access to services, to activate subscriptions, and to contact users for service delivery purposes. WeFit will not disclose any data held to third parties without the consent of the data subjects, and will not trade, exchange, or divulge such data to other persons, except as provided by applicable law. Personal data may also be processed and used by WeFit for statistical and subsequent promotional purposes. WeFit does not collect transaction information such as card numbers, expiry dates, or CVV codes. This data is managed exclusively by the payment processor.
